Terms of Use

1. Who can use it

You must be at least 13. If you're under the age of majority where you live, a parent or guardian must agree to these terms for you. Purchases are made through Apple and follow Apple's rules for your account.

2. What DollarGuard is — and isn't

1. DollarGuard is a record-keeping tool. You enter your own transactions, and it organizes, totals and reports them.
2. It is not financial, investment, tax, legal or accounting advice. It doesn't connect to your bank and doesn't know your real balances unless you enter them. Totals are only as accurate as what you enter.
3. PATCH is an AI assistant, and AI can be wrong. It can misread your records, do maths incorrectly, or state things confidently that aren't true. Check anything important against your own records or a qualified professional before relying on it. PATCH does not recommend specific investments.
4. PATCH can propose new or changed transactions. They're saved only when you tap [ APPLY ]. You're responsible for what you apply.
5. We may change, limit, pause or discontinue PATCH or any feature, including the AI model it uses and its fair-use limits.

3. Your data and your backups

1. Your records are stored on your device (see the Privacy Policy). We can't recover your data, your passcode or your backups. If you forget your passcode, the only way back in may be deleting the app, which erases its data.
2. You're responsible for keeping your own backups (iCloud backup in Settings, CSV export, or your iPhone backups). Test that you can restore them.
3. If you enter information about other people (for example a shared household account), you confirm you have the right to do so.

4. Purchases, subscriptions and fair use

1. Pro is a one-time purchase that removes the 2-account limit on your Apple account. It doesn't include PATCH.
2. PATCH is an auto-renewing subscription, monthly or yearly. It includes up to 300 questions a month under fair use; once you reach the limit, PATCH may pause until the next month. We may change the limit — a change applies from your next renewal, and we'll tell you in the app first. Free trials and introductory offers follow the terms shown at purchase.
3. Payment is taken by Apple. Subscriptions renew automatically unless you cancel at least 24 hours before the period ends, in your Apple ID's Subscriptions settings. Refunds are handled by Apple under its policies.
4. Free users get a limited number of PATCH questions to try it.

5. Acceptable use

You agree not to:

• reverse-engineer, extract keys from, or send automated or unauthorized requests to our PATCH service
• use PATCH to generate unlawful, abusive or harmful content
• resell or sublicense the app
• interfere with the app or the service's security

We may suspend PATCH access for misuse.

6. Licence and ownership

We grant you a personal, non-transferable, non-exclusive licence to use the app on Apple devices you own or control, as permitted by Apple's Usage Rules. We (and our licensors) own the app, its design (including the terminal look) and the DollarGuard and PATCH names. You own your data.

7. No warranties

The app and PATCH are provided "as is" and "as available." To the maximum extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. Some places don't allow these exclusions, so parts may not apply to you.

8. Limit of liability

1. To the maximum extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost or corrupted data, financial decisions made using the app or PATCH, and fees or penalties from missed or mistaken payments.
2. Our total liability for all claims relating to the app is limited to the greater of (a) the amount you paid us for the app in the 12 months before the claim, or (b) CAD $20.
3. Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer under the laws of your province or state.

9. Your responsibility to us

If you break these terms or misuse the app, and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs, to the extent the law allows.

10. Ending

You can stop using the app at any time by deleting it. We may end or suspend your licence if you break these terms. Sections 2, 3, 7, 8, 9 and 12 survive.

11. Changes to these terms

We may update these terms. We'll change the version and date, and show important changes in the app. If you keep using the app after changes take effect, you accept them. If you don't, stop using the app.

12. Law and courts

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Courts in British Columbia have non-exclusive jurisdiction. If you're a consumer, you keep any right to sue in your home courts that your local law gives you.

13. Apple

1. These terms are between you and us, not Apple. Apple isn't responsible for the app or its content.
2. Apple has no obligation to provide maintenance or support for the app.
3. If the app fails to meet any warranty that applies by law, you may notify Apple, and Apple may refund the app's purchase price. Apart from that, Apple has no warranty obligation for the app.
4. Apple isn't responsible for claims relating to the app, including product liability, failure to meet legal or regulatory requirements, consumer-protection or privacy claims, and intellectual-property infringement claims.
5. You confirm you're not located in a country subject to a US government embargo, and not on a US prohibited-parties list.
6. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
